AMC, Police team return after learning Paldi society illegal construction case is in HC

Ahmedabad: A team from the Amdavad Municipal Corporation (AMC), accompanied by police personnel, visited the Nutan Sarvodaya Society to take action against alleged illegal construction reportedly violating the Disturbed Areas Act. However, the team later returned after learning that the matter is currently under consideration by the Gujarat High Court.

The incident follows the issuance of a notice under Section 260(2) by the AMC on October 3, 2025. The property owner challenged the notice by filing a Special Civil Application before the Gujarat High Court. The case was scheduled for hearing before Justice Mouna Bhatt on October 7, but, at the request of the AMC’s panel advocate, the hearing was deferred to October 8 at 11 a.m.

It is learnt that the AMC and police teams, unaware of the ongoing legal proceedings, had arrived in large numbers to take action. Upon realizing that the matter was sub judice, the teams withdrew.

The property owner has also submitted a written representation stating that since the petition challenging the Section 260(2) notice is pending before the Gujarat High Court, the AMC is restrained from taking any coercive steps until further orders. Any action taken during this period, according to the applicant, could amount to contempt of court.

Officials confirmed that no further action will be taken until the High Court’s next hearing clarifies the legal position.

Ellisbridge MLA Amit P. Shah had earlier raised this issue during a coordination meeting in August. He claimed that members of the minority community had carried out unauthorized construction, including merging two adjoining bungalows in Nutan Sarvodaya Society to create a single large structure, bypassing Ashant Dhara regulations. Following this, the property owner had initially begun voluntarily demolishing the illegal structures. However, with the fresh notice issued by the AMC, the matter has once again come to light.
